Why New Zealand Is Introducing a Cap on Digital Gambling Operators

The online casino market will force licensed operators to adhere to discretion and harm minimisation. Operators will need to implement age verification, risky gambling behavior detection, and monitoring systems.

Reforms also include a tax component. As discussed in government policy papers, a taxed, online casino market with a legalized marketplace could yield substantial new tax income through both licensing and gambling taxes.

How the 15-Licence System Will Work

The government will implement the licensing framework in phases. The first phase will be the government collecting ‘expressions of interest’ from gambling operators for potential market entry.

As per the instructions of the Department of Internal Affairs, the first gambling licences will be issued by the end of  2026. Interested operators must first prove a sound financial position along with the ability to meet various compliance requirements.

The government plans to issue the licences through a bidding process. Only applicants who meet the above requirements will be eligible to bid for a licence from the limited number of licences available. This approach has been taken to resolve the issue of oversubscription to the licences.

After winning a licence, a company will be required to submit a comprehensive operational plan that includes policies on gambling, responsible gambling, and a description of the technology to be used. This plan must be approved by the regulator prior to commencing operations.

Licences will have a duration that is fixed duration. Policy documents state that they will start off lasting three years. After this period, they may be renewed for an indefinite amount of time as long as they maintain proper guidelines and regulatory compliance history.

The system will also have market concentration limitations. No operator will be permitted to have more than three licences, and each licence will be tied to one online casino brand.
